First homeowner's policy fraud case in the
state of Washington validated by the state Supreme Court.
The case holds that an insured's material misrepresentation
when filing a claim, voids the entire policy. The case involved
a total loss fire and claim exceeding $450,000 for house, personal
property, and additional living expenses.John Scrivner was the
Case Investigator, and also acted as the company representative
during the 3 week trial. |

Resulted in seven class action lawsuits against Avista
Utilities for $80 Million. This was the largest damage
lawsuit to be filed in Spokane County Superior court at the
time. The action resulted from a 60 mph wind storm caused
wild fire, October 16, 1991, knocking down trees and power
lines in numerous counties of Eastern Washington, and North
Idaho. The fire burned over 30,000 acres, 112 houses, and
resulted in 3 fatalities. John Scrivner was the lead investigator
for Avista, documenting origin and cause of over 50 fire start
sites. The case was resolved during mediation in 1997, avoiding
nine months of trial.

| US District of Idaho Case No: CR 00-0134 N-WFN |
| This 1999 fire resulted in criminal charges filed
against the daughter (client) of the owner for setting the fire.
After 3 grand jury hearings, 2 trials (2001), some prison time
served, and a successful appeal, all charges were dismissed (3/08)
except one not related to the cause of the fire. |
| Idaho 1st District Court, Case No: CV 04-1311 |
| In this commercial 2004 paint booth fire, the
Plaintiff hired the client to do some miner welding in the booth.
A fire resulted which destroyed the business. Mediation failed,
and a trial resulted in a defense verdict. |
| Montana 17th District Court, Phillips County,
Case No: DC 05-009 |
| In this 2/04 commercial building fire, the client
was charged with 7 felony counts relating to tenant endangerment,
and other arson charges. A former fired employee confessed to
police long after the fire that the client hired him to set the
fire for the Insurance money. The building had been removed before
we received the case. After several court hearings, all criminal
charges were dismissed in a plea bargain agreement. |
| Idaho 1st District Court, Case No: CV 05-02016 |
| In this Jan/05 fire, allegations of improper insulation
procedures were made against our client. The case was dropped
after a different cause of the fire was established. |
| Idaho 1st District Court, Case No: CV 00-3070 |
| This case involved a collision between two skiers
at the Scweitzer Ski area resulting in serious injuries. The court
determined that the client was not negligent to the required degree
in Idaho, and a Defense verdict was awarded. |
